This Terms of Service (“TOS” or “Agreement”) contains the complete terms and conditions that govern your use of the Laundry Club KC services, Laundry Club KC's website, including, unless otherwise expressly stated, any subdomains thereof, and any other website or application through which Laundry Club KC makes Services available. BY CONTINUING TO ACCESS, USE OR ATTEMPT TO INTERACT WITH, ACCESS OR USE ANY PART OF THE WEBSITE(S), CONTENT OR SERVICES OFFERED BY THE LAUNDRY CLUB KC, YOU AGREE THAT YOU HAVE READ, UNDERSTAND, AND AGREE TO BE BOUND BY THIS AGREEMENT. 1. The Laundry Club KC is not responsible for clothing or any other laundered items that bleed, shrink, or otherwise change as a result of normal washing. 2. The Laundry Club KC is not responsible for lost articles unless proven that The Laundry Club KC is responsible for the loss. 3. The Laundry Club KC accepts all garments sent to us and does not perform a piece-by-piece count. 4. The Laundry Club KC is not responsible for lost or stolen items pre-pickup or post-delivery. 5. The Laundry Club KC is not responsible for damage to items labeled “hand wash only”, “dry clean only”, "lay flat to dry", or any special care derivative thereof and is not responsible for checking for these or similar special care labels on Customer's items. 6. The Laundry Club KC is not responsible for loss of or damage to any personal or non-cleanable items left in clothing or bags including but not limited to money, jewelry or electronics. 7. The Laundry Club KC is not responsible for items left in clothing (e.g. ink pen, markers, lip balm, etc) or Member bag that may result in damage to clothing during wash. Customer agrees not to leave such items in their clothing or in Membership bags. 8. The Laundry Club KC reserves the right to refuse any customer and/or refuse cleaning any item. 9. The Laundry Club KC does not guarantee removal of stains. 10. The Laundry Club KC will not clean clothing infested with scabies, bed bugs, mites, fleas or any such contagious parasites or insects and will not be held responsible for any potential spread of any such contagious organisms. 11. The Laundry Club KC, at its sole discretion, may reimburse clients for lost or damaged clothing in an amount to be determined by The Laundry Club KC - this amount cannot exceed monthly membership dues or $25 total for every 10lbs of laundry regardless of brand or condition. Customer agrees to notify The Laundry Club KC within 3 business days of receipt of a delivery of any lost or damaged items from that particular delivery, failure to do so constitutes waiver of a claim for any lost or damaged items from that delivery. 12. The Laundry Club KC liability under this agreement shall be limited to general money damages in an amount not to exceed the charges for the term of service paid by Customer in the term under which the damages are alleged to have occurred. This liability shall be the extent of The Laundry Club KC's liability regardless of the form in which any legal or equitable action may be brought and the foregoing shall constitute Customers exclusive remedy. In no event will The Laundry Club KC be held liable or be responsible for any consequential, special, indirect, incidental, or punitive loss or damages whether or not The Laundry Club KC knew or should have known of the likelihood of any loss or damages. The Laundry Club KC disclaims all warranties expressed or implied with respect to the services rendered under this agreement. 13. The Laundry Club KC will not issue refunds for membership. 14. The Laundry Club KC reserves the right to withhold delivery for delinquent accounts. Customer must pay any outstanding balances prior to delivery of laundry, or as mutually agreed upon, to avoid delinquency. Customer invoices can be made available via phone, email, or text. 15. This agreement and any documents referred to herein constitute the complete, exclusive, and entire agreement between the parties, may not be modified except in writing signed by both parties, and shall be governed by all laws applicable by the state of Missouri, in which The Laundry Club KC operates.
